For rental assistance, HOME specifically prohibits assisting tenants that receive other direct subsidy, like Section 8/HCV etc. I have not seen any similar requirement for CDBG, but we have chosen to follow the HOME rules in this regard, because we believe it is a duplication of benefits to pay the tenant portion of those programs. If you think about how Section 8 works, as the tenant's income goes down, they can get their income reviewed by the PHA to reduce their required tenant contribution, and the PHA's portion of the rent payment goes up. So, if a tenant loses their income they should pay less rent. Additionally, PHAs are receiving a lot of CARES money of their own to increase the money they can pay for assistance, recognizing that many tenants will be unable to pay their expected share and the Section 8 program will have to pay more that they had not originally budgeted for. Check with your PHA to ensure that is how it works in your jurisdiction, and if it is, I would definitely say you cannot pay the tenant's share of these programs because there would be a duplication.
